USA v. Fratini New York Western District Court Case #: 1:22-cr-00151 Case Filed: Sep 21, 2022 Summary: The defendant of a Federal Case is in need of assistance with research on similar cases of "fantasy talk", possession of cache images in child pornography cases and attempted production, and the different motions that can be filed. Currently, the defendant is being represented by an Assistant District Attorney who has not provided adequate representation and is seeking to have them removed as their counsel. He has been indicted on 3 counts of possession of Child Pornography-cache images. One on an old cellphone and two found on another cellphone; and 1 count of attempted production (prepubescent). This was "fantasy talk" per the defendant, communicated via text to an adult woman. The defendant has never spoken with a child. The defendant was apprehended in the parking lot of a hotel where he was planning on meeting the woman. Officers found no equipment in his vehicle to support the claim of attempted production and the vehicle was later released to the defendants family as it was no longer evidence. The text between the defendant and the now victim who started off as a co-conspirator, is being used as evidence of the intent to produce, in addition to the defendant going to meet the woman.
